Demolition

If a building is found to be of no further use, is dangerous or is in a ruinous or neglected state, then it will be demolished.

Notification

When the owner of a builder decides that demolition is necessary a notice to local authority of intended demolition is required - see link below. They are also required to send a copy of the notice to any adjoining owners and to the gas and electricity suppliers.

Demolition works are also controlled by the Construction (Design & Management) Regulations 2007 and you are also required to notify the intended demolition to The Health & Safety Executive, Grove House, Skerton Road, Manchester M16 0RB.

Planning permission and listed building consent

In certain circumstances you may also require consent under planning legislation. This would apply particularly in relation to buildings that are listed as being of historical or architectural interest or within a conservation area. You should contact the Conservation and Built Environment Section of the Planning Department (Tel. 442819) for further information. The Planning department must also be given 28 days notice of any demolition works affecting adjacent residential properties.

Survey

On receiving notification we will survey the building and prepare a report on the premises taking account of how the works will affect public safety. This will form the basis of the counter notice.

Counter notice

This will contain requirements that the demolition contractor should undertake. Copies of this notice will also be sent to adjoining owners, gas, electricity, water and telecommunications suppliers and other departments of the council. The counter notice will also contain requirements in connection with shoring up and weatherproofing any adjacent building, repairing and making good any damage to an adjacent building, removal of rubbish and site clearance, disconnection, sealing or removal of any drains or sewers, making arrangements for disconnection of any services, the burning of materials or structures and any other steps reasonably necessary for the protection of the public and the preservation of any public amenity.

Appeal against notice

Any appeal against the counter notice should be made to the Magistrates Court.
